So I had this recently after it had gone totally flat. I couldn't get it to charge from the keyboard. I then found my Surface had a firmware update which after applying I found did charge again. If you haven't worth checking

not all surface pens have rechargeable batteries

  Correct - but the Surface Slim Pens do use rechargeable batteries. The Previous Generation of pens (non slim pen) use AAAA batteries.
